Not a like-for-like swap
Building and Energy lists when you can apply — no schedule by the due date, a schedule you disagree with, or a scheduled amount that isn’t paid — and then says:

Start with the date on your contract. The SBDC puts it simply: The Act applies to contracts entered on or after 1 August 2022.

The sentence to write is on the write-it-yourself card above. And the timing: You must submit your payment claim within six months of completing the work or supplying the goods/services, unless the contract specifies a longer period.
The respondent must provide a payment schedule within 15 business days of receiving your payment claim, or within any shorter period specified in the contract.

The claim clock counts Monday to Friday. It doesn’t take public holidays out, so we check the exact date before you rely on it.
The SBDC lists no payment schedule after 15 business days as one of the situations where you can apply for adjudication. So is a scheduled amount that isn’t paid.
Building and Energy says you must act quickly, and the timeframes differ by situation. Ring us the day the schedule is due, not the week after.
There are adjudication fees to consider. Generally, these are split equally between the claimant and the respondent.

Those fees are the adjudicator’s. Our fee for preparing the application is separate and fixed: $1,850, or $2,950 over $50,000.
